For the purposes of these Terms and Conditions of Use, the following definitions will be used, regardless of whether they are used in singular or plural form:

USER: Refers to any individual of legal age who accesses this website to browse the site and/or creates a registration account and/or makes a purchase. It is presumed that the User has the mental and legal capacity to purchase Products using a credit or debit card.

PRODUCT: Any physical/tangible item marketed on this website.

Assumption of Risk and Liability Waiver

I confirm that I am in good physical health and fully capable of participating in the outdoor activity I have chosen with Sensoria. I understand that this activity involves inherent risks, including but not limited to serious personal injury, property damage, and even death. These risks stem from the unpredictable nature of outdoor environments, including rugged terrain, wildlife encounters, and extreme weather conditions. These inherent risks are an integral part of the experience and cannot be eliminated without altering the fundamental nature of the activity.

I acknowledge that injuries and damages can occur due to natural causes or the actions of other individuals and wildlife. The activity involves hiking over challenging and unpredictable off-trail terrain, such as boulder fields, downed timber, river crossings, mountain passes, steep slopes, and slippery rocks. Risks associated with these conditions include, but are not limited to, collisions, falls, capsizing, and drowning. Additionally, environmental hazards such as rapids, extreme temperatures, insects, snakes, large predators, falling rocks, lightning, flash floods, and volcanic activity are possible. Health risks may include sunburn, heatstroke, dehydration, and other conditions ranging from mild to serious.

I recognize that the enjoyment and excitement of outdoor activities come with these inherent risks, and that these risks contribute to the overall experience. I accept that the activity takes place in a remote area, which may be several hours from the nearest medical facility, and that communication and transportation challenges could delay emergency care. In consideration for my participation in this activity, I agree to the following:

– I have read and understood all rules and conditions provided by Sensoria.

– I will cover all costs and fees related to the activity and understand that Sensoria is not responsible for transportation to and from the activity location.

– I am responsible for any risks associated with traveling to and from the activity and for any decisions to leave the activity early or continue without a guide. I waive any liability claims against Sensoria for such decisions.

– Sensoria reserves the right to exclude any participant deemed unable to meet the activity’s demands or unwilling to follow guide instructions.

In case of an emergency, I authorize Sensoria to provide or arrange for emergency medical treatment, including hospitalization and surgery if necessary. I understand that all associated costs, including those for medical services, transport, and accommodation, will be my responsibility or that of my parent/guardian. This waiver is intended to be as broad and inclusive as permitted by law. If any provision is found to be invalid, the remaining provisions will remain in effect. I release Sensoria, its agents, assistants, and leaders from any liability for injuries or damages arising from the activity and agree to hold them harmless for any claims resulting from my own negligence. This agreement is binding on my heirs, executors, administrators, and any minors accompanying me. I hereby agree and consent to the foregoing agreement on behalf of the minor below.

Purpose of the Website

The purpose of this website is to inform and market to all Users the information, products, and services offered by Sensoria as a provider of experience services in Rincon de la Vieja, exclusively for products of the SENSORIA brand, without implying that products or services from other brands may be marketed. The design, presentation, or configuration of the website, as well as its contents, may be modified at any time and without prior notice.

Use of the Website

SENSORIA reserves the right to interrupt access to the Website at any time and without prior notice, as well as to interrupt the provision of any or all services provided through it, whether for technical, security, maintenance, power supply failure, or any other reason. Such interruption may be temporary or permanent. SENSORIA does not guarantee the reliability and availability of its Website, so the use of the same by the User is at their own risk. Certain services are exclusive to registered users; their access is restricted and may be subject to specific conditions that, where applicable, replace and/or modify this Legal Notice. In these cases, as a prerequisite to access the service, the registered user must log in with their identifier and password. The use of the password is personal and non-transferable. The person authorized by SENSORIA agrees to use it diligently and to keep it secret, assuming all responsibility for any consequences resulting from its disclosure to third parties.

In general, the User agrees to comply with these terms and conditions of use and to always act in accordance with the law, good customs, and the requirements of good faith, using the diligence appropriate to the nature of the service they enjoy, refraining from using the website https://sensoria.cr in any way that may prevent, damage, or impair its normal operation, the assets or rights of SENSORIA, other Users, or any third party in general.

In particular, and without limiting the User’s general obligation under the previous section, the User agrees, in using the Website, to: (i) Not introduce, store, or disseminate on or from the Website any information or material that is defamatory, insulting, obscene, threatening, xenophobic, incites violence or discrimination based on race, sex, ideology, religion, or that in any way violates morality, public order, fundamental rights, public freedoms, honor, privacy, or the image of third parties, and in general current regulations; (ii) Not introduce, store, or disseminate through the website any computer program, data, virus, code, hardware or telecommunications equipment, or any other electronic or physical instrument or device that may cause damage to the website, any of the services, or any of the equipment, systems, or networks of SENSORIA, any User, or any third party in general, and/or that in any other way may cause any type of alteration or prevent the normal operation of the same; (iii) Properly safeguard the “Username” and “Password” provided by SENSORIA, as identifying and enabling elements for accessing the various services offered on the Website, committing not to transfer their use or allow access to them by third parties, assuming responsibility for any damages that may result from their misuse; (iv) Not destroy, alter, use for their own use, render useless, or damage the data, information, programs, or electronic documents of SENSORIA, its Users, or third parties; (v) SENSORIA reserves the right to remove all comments and contributions that violate respect for human dignity, that are discriminatory, xenophobic, racist, pornographic, that attack youth or childhood, public order or safety, or that, in its opinion, are not suitable for publication. In any case, SENSORIA will not be responsible for the opinions expressed by users through forums, chats, or other participation tools; (vi) SENSORIA may, at any time and without prior notice, modify the content of the website, as well as these General Conditions and any Specific Conditions that may be included, by publishing such modifications on the website so that they can be known by Users.

Use of Anonymized Data

During the User’s visit to the website www.sensoria.cr, the following information is obtained from the User through the website:

• The IP address assigned by the ISP to the user and the domain name of the ISP.

• The domain from which the user connects to the Internet.

• The date and time the user accessed the website.

• The Internet address from which the website was accessed (if accessed through another URL).

• The total number of visitors accessing our website.

SENSORIA is committed to using the data, respecting their confidentiality, and using them in accordance with the aforementioned purpose, as well as complying with its obligation to safeguard them and adapt all security measures to prevent the alteration, loss, processing, or unauthorized access of personal data, taking into account at all times the state of technology. However, security measures on the Internet are not infallible and there may be leaks due to malicious actions by third parties.

In the event that the data provided is associated with a purchase, the legislation requires us to keep it blocked for a certain period, at least for four or five years, available to the different Public Administration bodies or to comply with legal obligations. SENSORIA is committed to indicating the price, warranty, availability, and characteristics of each Product marketed on the website, as well as the terms and conditions established, which are considered important and established in Law 7472 on the Promotion of Competition and Effective Defense of the Consumer.

The description, restrictions, conditions, and observations established by the Provider for each Product are binding on the User and will form an integral part of these Terms and Conditions of Use.

SENSORIA will make the following email info@sensoria.cr available to the User, intended to receive inquiries, suggestions, comments, and/or complaints that the User may have related to the operation and management of the system, in order to optimize its functioning.

To the fullest extent permitted by applicable law, the User understands and agrees that neither SENSORIA nor any of its subsidiaries or affiliates or third-party content providers will be liable for any direct, indirect, incidental, consequential, or any other damages related to or resulting from their use or inability to use this site or any other site the User accesses through a link from this site or any action SENSORIA takes or fails to take as a result of email messages the User sends to them. These include damages for errors, omissions, interruptions, defects, delays, computer viruses, loss of profits, loss of data, unauthorized access to and alteration of their transmissions and data, and other tangible and intangible losses.

Intellectual Property

The material and content on this website, as well as the SENSORIA brand, are protected under the current and valid legislation of Costa Rica and international conventions regarding intellectual property rights. The User expressly acknowledges and accepts that the use of material or content published on SENSORIA is not permitted for commercial purposes or other purposes not described here, therefore the User may not copy, download, market, modify, publish, distribute, create works, or derive any other benefit in any way without the prior written authorization of SENSORIA.

Modifications

SENSORIA may make edits and improvements it deems appropriate, without the need to notify the USER, make corrections, additions, improvements, or modifications to these Terms and Conditions of Use. Such modifications and/or adaptations will be applicable to the User from the moment of their publication on SENSORIA. It is the User’s responsibility to periodically review the TERMS AND CONDITIONS OF USE, PRIVACY POLICY, SHIPPING AND RATES POLICY, and RETURN POLICY of COMPANY NAME, accessible on this same website, in order to stay informed of such updates.

Jurisdiction and Applicable Law

The applicable law in case of dispute or conflict of interpretation of the terms of these conditions of use, as well as any matter related to the services of this site, will be that of the Republic of Costa Rica. The courts of Costa Rica will have exclusive jurisdiction over any claim that arises or is related to a visit to our website, although we retain the right to bring proceedings against you for breach of these conditions in your country of residence or any other relevant country.
